Two more healthcare organizations are paying to put website tracking litigation behind them, with Banner Health and LifeStance Health Group both reaching settlements over pixel and analytics tools.
Banner Health, whose 33 hospitals span six states out of its Phoenix headquarters, faced consolidated class actions tied to tracking technologies used on its site from June 2020 through November 2023. Plaintiffs alleged the setup handed sensitive information to Meta Platforms and Google. The deal covers attorneys’ fees of up to $3.75M, settlement administration costs, and $2,500 service awards for each of eight class representatives.
LifeStance Health Group, a Scottsdale behavioral health provider, denies any liability but has agreed to fund a $3,027,874.44 settlement pool carved into two subclasses and will drop all third-party tracking tools for five years, apart from those fully compliant with the HIPAA Rules. Class members face an August 31 deadline to object or opt out, with claims due September 29 and a final approval hearing scheduled for October 16. The agreements follow Atrium Health’s $1.8M payout and Allina Health’s $12.5M resolution in the same tracking-pixel wave, keeping pressure on providers over ad-tech data flows.
