A Florida vendor of sleep apnea equipment has agreed to a class settlement worth up to $500,000 over a breach first disclosed in 2024, court filings show.
Jacksonville-based CPAP Medical Supplies and Services sells durable medical equipment used to treat sleep apnea. Investigators concluded that an unknown party was inside the company’s network from December 13 to December 21, 2024, and may have walked away with personal and protected health data on patients and staff, both current and former. Regulators at the HHS Office for Civil Rights were told the total reached 90,133 people. Patients learned of it around August 15, 2025.
Litigation began with four complaints in Florida’s Middle District, later folded into the earliest filing. A partial dismissal kept the case alive. On September 4, 2026, the sides settled. The matter, Brett Conner v. CPAP Medical Supplies and Services, now sits in Broward County Circuit Court. The company denies any wrongdoing.
Those covered receive two years of medical data monitoring and may seek as much as $5,000 for documented, unreimbursed losses, with pro rata cuts if claims exceed the fund. No straight cash option exists. Opt-outs and objections are due October 30, 2026; claim forms must arrive by November 26, 2026; a fairness hearing was scheduled for December 1, 2026.
